During my career as an arborist, I have been exposed to several customers (typically commercial accounts) that have been
found guilty of negligence on their properties which resulted in successful lawsuits.  In laymens terms, it basically meant
that they permitted a predictable hazard or a security hazard to exist.  Examples are:

  • Poor lighting of walkways
  • Poor lighting of parking areas
  • Tree stumps in areas of expected pedestrian traffic (lawns/footpaths/play areas)

Commercial property owners are forced spend profoundly absurd amounts of money on insurance premiums.  Ample
lighting, whether it is for a walkway or for enhanced security, is extremely important when managing commercial
property.  Areas where there is expected foot traffic should be clear of tripping hazards.  

Predators frequently lurk in dimly lit areas, waiting for victims.  Proper "spill" of lighting deters would-be assailants from
hiding, enables tenants to scan their surroundings, and proceed at night with caution.  
Proper "spill" of lighting is obtained through adequate pruning of trees which are growing in close proximity to lights,
while attempting to maintain an aesthetically pleasing tree.

Structures are constantly exposed to the elements of their environment.  Maintaining a shrub and tree clearance of at
least 18"-24" from structures will:

  • help reduce the amount of mold & moss on shingles
  • prevent paint from being worn from fascia and siding
  • prevent shingle wear on roofs
  • ultimately prevent structural decay, rot, leaks and insects


In general, proper pruning of trees helps enhance the structural integrity and beauty of the trees.  They can add thousands

Most are easily corrected with proper pruning technique.
The trees below are in an office park located in Washington Twsp, NJ.  They are the perfect example of neglect.  The owner of this
property chose not to have his trees pruned for aesthetics, but rather more utilitarian.  
Professionally, I would not have performed such extensive elevation and crown reduction,
but the property owner insisted, and didn't want to have to "worry about them" for another 10-12 years.

The first set of pictures show a Linden/Basswood that had it's branches not only laying on the roof,
but also pushing up the shingles and abrading the paint on the fascia.  This is beyond neglect.  It has been over 10 years since these
trees have been given any attention.
The Cherry trees below reflect two nice examples; neglect and poor planning.  
Landscape designers are notorious for planning only for the moment, and not ten or more years in the future.  As evidenced by
the photos, the root flare has completely lifted the tenants A/C unit.  
(By the way, the tenants are responsible for any repairs).  
Again, this is beyond neglect, but a complete indifference on part of the landlord.
These are just some leftover pix of more neglect, and tripping and safety hazards.
